Big Paper [draft]

A lot of people have different aspects of what the American Way of Life is. There are also the dominant frameworks which is capitalism and the government that influences the American way of Life positively and negatively. We all live in a different American way of life which affects us differently with each aspects that America has created for us as well as how the dominant frameworks control our life.

Many people that I have interviewed think that the American Way of Life is about freedom and success. A middle class white female teacher said that the American Way of Life is “freedom of speech” and the freedom of being “able to live how we wanted”. A middle class Asian male said that we come here to become “independent, get our own job, own things and to be able to live by ourselves”. This connects to what the teacher said about how the freedom works in the American Way of Life. The pattern that I see is that the people think of freedom as being able to work and living the way they wanted. In general the people are not being told of how to live but they find their own way to live how they want. They also have their own choice and rights to choose from to become independent and work hard. By saying that the American Way of Life has a lot of “freedom” (said by others) shows how we have more opportunities than other countries (in a way).

However another middle class white male said that we have “false” freedom and we do not come to America to “work, to get rich”. Sometimes when people want to get rich, or become successful, they would use “varies means” to get the success they want and become rich. Another pattern in the American way of Life is it seems that the more work they do, the richer they can get and achieving more success to get the freedom they want. Many of the people I had interviewed are mostly middle class people; this made me think that they are working hard to get money and success. Also I observed that the people who are in the middle or low class does not have as much freedom as the rich people so they have to do much more work to get what they want. So their perspectives on the American Way of Life are different than the other classes in the society.

With the aspect of being successful, age difference matters as well. Since some adults can find work, they can have money to live by themselves and support themselves. However, children and teenagers (ones that seem to have a hard time finding jobs) are the ones who need support from the adults (parents, relatives, foster parents or responsible adults). The children and the non working teenagers would have a lot of time on their hands so they would do much more activities or maybe none. One of my classmates named Maggie said in terms of her soul connecting to the American Way of Life, she does “not live in a meaningful life” because she has no job and is unproductive. However she compared how when people get a job, they would feel tired and desperately wants a break. This shows how when people have a job, they have a lot of free time but when people do have a job, they would get busy and would not get a lot of freedom so are unable to do what they want to do in their personal lives. So noticing about the age difference, the “success” of the American Way of Life for the children and non-working teens are different than the “success” of the American Way of Life for the adults.

We all describe the American way of life differently because we all do not live the same way. We might all have the same ideas of how American is such as "freedom" but besides the good things, there are also the negative aspects of the American way of life. We do not truly see what these negative aspects are because individuals are being manipulated by them and are covered with it, the good aspects. This leads us to the dominant frameworks of the American way of life where people are blocked from the negative things and receiving the positive.

The Dominant Frameworks of the American Way of Life is a mix of capitalism and the government working together, which networks how people live and decisions. To understanding, we need to know what the basics of some definition of capitalism. Capitalism is an economic system that consists of private ownership of wealth, profit motive (making money), and producing products/goods and sells those goods in the free market. The "invisible hand" (the way in which how market competitions and self-interests would create situation that organizes and benefit society) sort of helps controls the market so that everything would somehow work and everything would flow. Free market is where people go get profit and putting investments and having their own companies with selling, buying, and trading (Globalization). Three aspects that we use to show how capitalism works are Land (is the raw materials that we use to make the products), Labor (is all the work necessarily to sell, distribute and produce) and Capital (is the factory, machinery, companies who get the profit) we can see how capitalism work in a way that makes everything united in a way.

We are all in the same boat, but working in different levels but in the end everybody's knowledge of "things" (also combing with their own interests or "greed" to make money) would benefit everybody to make the whole boat working. The people also get a chance or chances to go from "rags to riches" or upward mobility, making them able to become monopolies, natural monopolies, monopsonies or getting a company of their own and getting profit for themselves. In capitalism, there is also economics involve in the free markets = lots of commodities (something that can be bought and sold in the market place or perfectly substitutable) and competition. The good thing about the competition is that if a lot of people are competing in one thing then prices would go down which means people can afford the price better than before.

Capitalists get their money by having people buy their products. How? One way that they earn huge profits are the holidays.
For example, in Black Friday, this year, in Wal-mart, one of the workers gets trampled over by the customers. In the article, "Worker dies at Long Island Wal-Mart after being trampled in Black Friday stampede", and as the title suggested, one of the wal-mart workers got trampled to death along with "four shoppers, including a woman eight months pregnant, were injured" (above article). This year's Black Friday in Long Island Wal-mart had an "'out-of-control' mob of frenzied shoppers". There was "roughly 2,000 people gathered outside the Wal-Mart's doors in the predawn darkness" and the workers have to take "the doors off the hinges". This incident connects to the American way of life in a lot of ways. Generally it shows that people are selfish, ignorant (Massiel), "don't have their priorities straight" (Andy Lu), and they "rather save money" (Andy Lu). Because of this out break of people, workers have to fight and get out of the way to "live". At the end of the article, one of the employee says, "How could you take a man's life to save $20 on a TV?" This shows how we care for the "$20 on a TV" rather than the "man's life" and how we put our desires first. Why not the other way? Since there is about 2,000 people, I think about 3/4 of the people don't even know what had happen when the man fell down and gotten trample because they were in the back, pushing to get in. I think the people are rather desperate to get their things or they are just going to the store to get things "upgrade" instead of really needing it. This connects to the economics because as price goes down, demand goes up and like this wal-mart example, the people becomes "savages" (Witness Kimberly Cribbs said). This shows how we go way extreme than we should which causes us to become like "savages" and injuries occured.

On Black Friday/Buy Nothing Day, I stay home because there was not much things I needed to buy. Hearing from some of the classmates (today), there was alot of people that went crazy with the shopping malls and other places that was holding the Black Friday Sale. Also a person got trample to death... Which is also a reason why because I do not feel like getting trample by people. An observation that I noticed is that after having the Thanksgiving feast and giving thanks out, the next day is the Black Friday and Buy Nothing Day. I feel it's more of a compeitition after a relaxing day of stuffing yourselves with yummy food. It seems that at one day they are thankful and then the next day they turn all competitive to try to get as much they need or just want to buy it because its pretty or cute. Guessing from this, I think that our American way of life style is that we do things extremely and that we tend to raise competition more. *We have more competitive power hahaha~* Maybe because the economic is falling quite down, people are trying to get the cheap stuff to save themselves but it also shows our greediness in things.

Thanksgiving is also a big part of the American way of life and like Christmas and the New Years, we buy a lot, and our greed builds up to meet the capitalists profit. Since I do not celebrate Thanksgiving because it is not in the Chinese tradition, I am not sure how "warm" Thanksgiving it to others. For others who are celebrating Thanksgiving, in this period of time, it does not seem to have much meaning of giving thanks because as I see it in the supermarkets and elsewhere, the people are just buying food and hurrying home to finish making the preparation. In psychology class, when Thanksgiving was mentioned, a lot of people was mentioning all the food they would eat but for the meaning of Thanksgiving, there was not much of discussion for that. It shows how the meaning of Thanksgiving is slowing disappearing and the only thing we know about the meaning of Thanksgiving is giving thanks, which does not show much of appreciation? The history of Thanksgiving, when I heard it was there was a lot of versions, which also shows how the people, I don't think they mean it but they are kind of twisting the history of the Thanksgiving holiday. We are not really learning the true meaning of Thanksgiving but taking bits of pieces we hear from others and not the whole, which makes us just wanting to celebrate the Thanksgiving because it is a holiday and not celebrating because of the meaning behind the word, "Thanksgiving".

Christmas gives the capitalism a lot of profit because everybody is buying materials and ingredients for their family gatherings and decorating their whole house plus the tree. Shopping is always hectic and crowded, which is good news to the sellers because they make money. Santa Claus, a figure representing Christmas, "Ho, ho, ho, Merry Christmas" is what the Santa always say and if you are "good" or a "bad" girl/boy this year. Little kids believe in it very much that the capitalist use it to capture and using the little kids for profit. Many little kids get want a lot of things and because it is Christmas time, the parents does not refuse too much to buy what the little kids. For Christmas, besides giving gifts, the Christmas tree is a big aspect because in the class discussion before the vacation, we talked about Christmas. Then we go to the tree and because we chose the pine tree because the leaves does not fall off symboling how it does not die easily (even though it is when its cut down). It also connects to Jesus and being immortal and giving new life. I feel that the Christmas carols and the "merry" songs that the people play also connects to more of the religious aspect because a lot of songs have "angels", and "joy".

New Year is also one of the biggest event of every year. There will be lots of celebration and everybody is all hyped for the new year to come. The ball drop is always shown on television and the feeling of waiting for the new year and the ball to drop, the people's excitement would flow in their chest. By the next second or so that the ball had drop, everybody would be exploding with partying and jumping up and down. It shows how the American way of life likes to "party" and celebrate a lot, which makes a lot of money for the capitalist. In a way, I think the people of America likes to shout alot because like sports and especially the big celebration/events, they would be shouting very loud to show their support for their team. This shows our extreme excitement and our support for the sports and events/celebrations.

Another major aspect that affects the American way of Life is the government, the "Constitution" - Supreme Law of the Land. In the blue print of the textbook that translates section 2 of article six, no one can make any laws that would be in conflict with “the constitution, acts of Congress, diplomatic treaties, or orders issued by the executive branch” shows the “supremacy” and the grand powers of how the federal laws work and have. In the “no religious test” clause, in my opinion, the significance is to not have any doubts between each members of the house. Because of the religious beliefs that each person has, they would have different opinion in different matters, making the whole house judgment to sway a bit and members would start to exclude the others. I believe having the “no religious test”, the members would be more united rather than separated and if they are not united with the same mind, the whole Congress would be unstable, making the people they have to protect start to waver about the members strength/power.

The preamble states that : "We the people of the United States, in order to form a more perfect union, establish justic, insure domestic transquility, provide for the common defense, promote the general welfare and secure the blessings of liberty to ourselves and our prosterity, do ordain and established this constitution for the United States of America." In the preamble, "we the people of the United States" would indicate you, me and each of the people living in the United States. Then they list all the things that would make the United Sates better and to protect the people of the United States. "We the people of the United States" is the most important phrase in the preamble, and where the government derives its power from the people to creat an "orderly, stable and just society" (taken from the textbook). However, looking at the preamble from the view of the present people, when stated, "we the people of the United States", where does the "we" come from? Does it truly mean us, the ones living in America right now. I don't think so, but rather it says "we" to include the future generation in one view. The other view is how when the Constitution is created, the white people are the ones who had signed it. We, meaning you, I and the others who have not signed it did not. So there, two views of how to see it. Additionally, by listing out their goals in the preamble, and connecting to the present world, those goals are getting better than the past since more rights have been passed and "freedom" has been more "free" on people than before.

When a person asked you the question, "If you have the influence/power, which amendment would you change?" it's quite hard to decide which one because there are alot of you could change but only a tiny bit of it can be changed. Seeing how the society is, if changing one side too much, the other side will become unbalanced. In the Amendments, one of the group that gives out the most importance is Amendment 13: Slavery is eliminated, Amendment 14: People born in the U.S. are U.S. citizens even if they are different skin color, and Amendment 15: All citizens can vote, does not matter on the race, or color. These three amendments are very important to the coloured people because now that the slavery is abolished, I think especially for African Americans, they would feel more free than ever. Additionally, they are now identified as "U.S. citizens", not "slaves" and they can vote like other people (white people) can. These amendments are able to make America more equal and more just like the preamble wants it to be. It had made at least half the people of the population of that time period to receive equal rights like others. (Source taken from http://firebolt.com/constitution/amendments.html#AM11) Also having the 14th amendment combine with the "no religiuos test" claus can give a vision of a diverse and equitable society with no government discrimination because in a way, everybody has to follow it. And their goal was to create the society to be equal and diverse. In the 14th amendment, everybody is counted equally in the census meaning all the races are counted fairly. In the "no religious test" clause, the Congress members cannot be discriminating each other because they are on the top and protecting people, if the members does not work together, it will be chaos for the people below. If they do work together and having the 14th amendment protecting the rights of the coloured people, the society would become more balance, equal and having more people to be joined into the society. It would also affect the change the white people had on the coloured people and maybe the coloured people on the white people. It will take a long time to get that vision to become successful but I think because of the 14th amendment and the "no religious test" clause, it gives a chance to renew and refresh many (maybe) of the conflicts and change it in a way to give everyone the right to say something for themselves.

From amendments 16-27, I find amendment 19 where all the gender can vote important because since I am a girl and at that time, before 19 came the women were not able to vote. But because the 19th amendment let all gender to vote, it makes a huge different to the women and gave them another right to sound out their voices just like how the coloured people are able to vote and give their opinion on who they want as their leader.

Learning from the Constitution, I think the general tendency of the Constitution and Amendments in my view of steady expansion of human freedom and decensy are how a lot of rules in the Constitution and Amendments are still approving and a lot of them, in the amendments have given a huge step in the society. There are a lot of reverses and contradictions in no particular direction because it depends on the history, what had happen in that era that affects the direction. I think there are always betrayals of democratic ideals by corrupt officials although I do not know much about them but there are always increase and decrease of those betrayals and the corrupt officials. Additionally, I believe that there are always an eternal battle between the evil and good sides of humanity because that is how we are able to live through, experience what humanity should experience by whoever created us.
In the Constitution, I think the most important ones are the preamble to start with...."in order to form a perfect union, establish justice, provide for the common defense, promote the general welfare, and secure the blessings to ourselves and our prosterity". America is still improving to fulfill these goals that the author's had. America may have these goals come true, and throughout the America history it has improve a lot for many eyes to see, especially mine. In the Judicial section, it is a good thing for the U.S. to not execute anyone and I think that gives people a good chance to refresh their lives if they do make a renew of themselves. A big part of the amendment I think has improve alot and has given America to become a more diverse and equal society is the 13th Amendment, Abolition of Slavery and a part of the 14th Amendment where everybody are all counted equally. Because of the abolition of slavery, many coloured people are not the same as today, racism has lessen and everybody are able to communicate with each other. Additionally, because as everybody is counted equally, we are able to feel equal as time went on. As history goes on, the constitution and the amendments are always changing differently and so whether it is evil and good side, it always changes because of time. Since the consitution and the amendments have been created long ago, many things have improved and many things have changed.

The constitution, as amended has create a lot of opportunities for the others, especially in the amendments to give other races to experience in the past a new life such as voting and no more slavery. They were able to live equally with the white people. It helped shape the American way of life today and it connect to all the deeper in the constitution part where today is more of a diverse and equitable society than before. There are alot of rights such as the right to vote plus all the gender to vote, abolition of slavery and more of the big rights. The Bill of Rights gave the people the right to practice their religion, freedom of speech, press, assembly and petition. Students lives in the school and how the school system are, the congress can not change which I think help us, the teachers to teach the way they would to pass on their knowledge to us. However there are also the constraints of what the school board wants and how the teachers have to teach at the grade level. Also, the constitution creates hope and change for us which affects our American way of life. The constitution also constrains the people to behave. If the Congress and the supreme law do not control the people, it will creat havoc. So that's why a lot of the rules in the constitution is to have people to become a more in a way "nicer", and less discimination between people. The constitution is trying to create a "justice" and equal society. Even though the American way of life are listed as "freedom", we always have a invisible rule that guide us, half of us to have control and half the others to become the opposite. Then the society is build upon to have the good versus evil to control each other. I think the constitution shape a lot of the ways in our American way of life. We have a capitalism economic system in America and because the constitution didn't forbid us we are able to have a bigger wealfare than other countries. Generally I just think that how the constitution and the rules on the Congress and the president to become faithful to the people and the supreme law. The people are able to choose more and has been living better than in the past. Finally, I think after the constitution and the amendments were made that we were able to live far differently from the past and our American way of life has changed throughout the period and still has been improving greater.

Thanksgiving Day [Fixed]...Buy Nothing Day...Black Friday...hmmm....

My family does not celebrate Thanksgiving because it is not really in the chinese culture even though My family and I are in America. But on Thanksgiving Day, my mom sliced up tiny pieces of turkey meat and made fried rice with it. It was an okay combination but it does not taste really good. The turkey meat were rather dried and bleh... Hearing and talking with others about their Thanksgiving brings me back to why we actually celebrated. Is it because of the pilgrims? Because we are trying to unite our families together by having all the family members sitting around the table, eating the main dish, turkey, and other dishes that comes along with it? What does Thanksgiving really means besides the giving "thanks" (which spells out in the Thansgiving word)? It seems that Thanksgiving does bring people more together and all the yummy, and warm food that the families make for the whole family gives out a nice feeling... and it kind of gives out the message of "enjoy it with your family as much as possible in one day with all the yummy foods".
On the news, I saw people lining up in a school or an organization (I am not sure) to get a Thanksgiving dinner. In a way, I see it as the school giving thanks by giving out food to the people who can't have it and the people who is lining up just wants to have the food to feed the family. What do the people who get the food give thanks in return, just by saying "thank you" and walk out? I am not too sure. Since I do not celebrate Thanksgiving, I would think of it as an extra two days off of school. Winter Holiday Assignment 1st

This Winter Vacation is like any other vacation I had in my life. Okay, even though it has the Christmas and the New Year's holidays, I do not feel as excited as others would (well, maybe for the presents). Since my family does not celebrate either of those two holidays, so it is just the same vacation. The only good part I could think of is that this vacation is longer than the rest of the vacation we have from school except summer vacation. Like others, I still expect the new year coming and new and good things coming; 2008 will be past and 2009 will be the new.
For Christmas, my family didn't have a family gathering and eating dinner or anything like that. However, my relatives send cards and a check to show their Christmas spirits. As I am writing this post, I started thinking what I would do next week but most likely, it would be staying at home, relaxing, surfing on the internet and watching anime. The outdoors activities will not be much, but going to watch movies, going here and there to see things will be it. I know there are many places to go, but it is not like I have that much money and anyhow, directions are not one of my best skills. Also, there are a lot of school assignments to do, especially exhibition and starting to think about college. I feel that this year's winter vacation is much more frustrating and too much things to think about. But then I guess, next year will be harder as well. I think this is part of my race as well in a way because I, as a chinese person, does not celebrate Christmas and I guess because it connects to religion, the Christians), I am not a Christian. Even thought my parents know about Christmas too, it is not in their tradition and it's not a chinese holiday. Therefore, there is not much point. I think that giving gifts is good but I do not see how it connects to Christmas in a way. But I think that because Christmas is a warm happy holiday, by giving gifts to each other shows that they care for each other and giving little pieces of their happiness to others.
Christmas and the New Year connects to the American Way of Life in a lot of way. I feel that the Christmas carols and the "merry" songs that the people play also connects to more of the religious aspect because a lot of songs have "angels", "joy" and other words (I do not really listen to them but then when I listen to it, it gives off more of Jesus's feelings and such). I think Christmas gives the capitalism a lot of profit because everybody is buying materials and ingredients for their family gatherings and decorating their whole house plus the tree. Shopping is always hectic and crowded so I do not do the shopping the day before Christmas. A big connection is Santa Claus, which the Coca Cola corporation made up. Santa Claus is a figure and is also representing Christmas. "Ho, ho, ho, Merry Christmas" is what the Santa always say and if you are "good" or a "bad" girl/boy this year. I think the people made up all of these things to give a "merry" feeling to everybody. Also because little kids believe in it very much that the capitalist use it to capture and using the little kids for profit. Many little kids get want a lot of things and by Christmas time, the parents does not refuse too much to buy what the little kids want because its Christmas.
New Year is also one of the biggest event of every year. There will be lots of celebration and everybody is all hyped for the new year to come. This shows our extreme excitement and our support for the sports and events/celebrations.

Ebay assignment

It was quite hard at first trying to figure out how to bid and what strategies to bid on. However because the item that I was bidding on did not have that much people bidding on it, it was quite easy. There was two people or maybe just one who was bidding against me. I was surprised when I placed in a bid, the refreshed page, there was a bidder already. So then I had to bid again but for some reason, it had to be added 50 cents higher for I thought one can just placed 1 or 2 cents higher. After 4 bids on the item, there was no more people bidding, which leaves waiting for the auction to end. It was nervous and exciting to wait for the last 10 or 5 minutes of the auction because no one would know if others would bid. Also if someone is going to use j-bid or not and if they do bid, one might not have enough time to bid again. Then they would lose the auction/item. However I won and it feel good to get the item you really wanted.
The experience on bidding in ebay connects to capitalism because it is like the competition in the free market or anywhere where people is trying to get profit. Because the seller has the items that people desire, depending on the quantity of that item, people would demand for it. If there is only a few, people would raise the price and compete with each other. Some people would raise the price a lot so no one can bid on it shows how our American way of life because for the things we want, we would compete it very large, for ebay, its the money/price. There's scarcity of items, people would demand more if the item is very popular and rare. Also, people would find the cheaper items, so the sellers have to make it cheaper so there's competition betwen sellers and buyers.

Deeper in the Constitution Part D

Given the distinction between a constitutional amendment and a law - if you had the influence how would you amend the constitution?
If I had the influence, I would amend the terms that a president can be in. In the 22th amendment, only President Roosevelt can serve more than two terms. Why is it only restricted for President Roosevelt? I think it is fair if there is a president as good as Roosevelt in the past to fix and lead America to a more higher level then they should stay for more terms. If the president are able to uphold all the expectations and having the majority of the people to vote for him, cheer for him, I think that president should have another term or a few if necessary. However, I still think there should be a rule where when the people think that the president is doing wrong, they can vote for the president to leave. In the constitution, if the president breaks laws, he can be impeached by House of Representatives and the senate but they do not state how people can vote as well. But what if the president didn't breaks laws or use too much strength but is not doing any good to the people? Shouldn't the people be able to impeach the president?

Another constitution amendment that I would amend would be 18th amendment where it prohibits/ban of alcohol but it was cross out in the Amendments. I think they should ban some alcohol, such as the really bad ones (although i do not really know). It is like cigarettes and smoking, alcohol can kill people too. I believe smoking and alcohol are considered drugs, the general drugs that kills a person's heart. In a way, I understand how people smoke and drink to get obstacles, bad thoughts, and stress out of their mind. People start binge drinking and smoking a large amount believing that they can forget a lot of the things that had haunt them, and well it do but it hurts the body parts and can make one go crazy. Then, there are the large dangerous drinks/alcohol that are there trying to earn profit and kill people. I think the government should ban those drugs in a way to lessen the people who drink a easier feeling. The government should cut out any trade that has too much dangerous alcohol it in them.

Question 4:
I think the general tendency of the Constitution and Amendments in my view of steady expansion of human freedom and decensy are how a lot of rules in the Constitution and Amendments are still approving and a lot of them, in the amendments have given a huge step in the society.
America may be perfectly have these goals come true, but throughout the America history it has improve a lot for many eyes to see, especially mine.

How does the Constitution, as amended, create/constrain/shape the American Way of Life?

Deeper in the Constitution Part C

Amendments 12, 13, 14, and 15 are often referred to as a major turning point in US government policy because these amendment rights were in the past, either was banned or given too much power to some of the race especially white people. Importantly, because of these amendments, a lot of people especially the coloured people are then free and has much of the equal rights the whites did. In amendment 12, it talks about the presidency and the electoral college. Amendment 12 is stating the president candidate who have the most electorate votes would be the president. Then the candidate with the second most votes would be the president. However today is different because the president gets to choose the vice president. It seems in the amendment, most of the votes are from electoral and because of amendment 13-15 there are more coloured people that are able to vote with freedom and make decisions. Amendment 13: Slavery is eliminated, Amendment 14: People born in the U.S. are U.S. citizens even if they are different skin color, and Amendment 15: All citizens can vote, does not matter on the race, or color. These three amendments are very important to the coloured people because now that the slavery is abolished, I think especially for African Americans, they would feel more free than ever. Additionally, they are now identified as "U.S. citizens" than "slaves" and they can vote like other people (white people) can. These amendments are able to make America more equal and more just like the preamble wants it to be. It had made at least half the people of the population of that time period to receive equal rights like others. (Source taken from http://firebolt.com/constitution/amendments.html#AM11)

Does the 14th combine with the earlier "no religious test" clause to guarantee a vision of a diverse and equitable society with no government discrimination?
I think the 14th amendment combine with the "no religiuos test" claus can give a vision of a diverse and equitable society with no government discrimination because in a way, everybody has to follow it.

After reading through the list from amendments 16-27, I find amendment 19 where all the gender can vote important because since I am a girl and at that time, before 19 came the women were not able to vote. But because the 19th amendment let all gender to vote, it makes a huge different to the women and gave them another right to sound out their voices.

Wal-Mart Worker Trampled Analysis

It was really surprising after reading the article, "Worker dies at Long Island Wal-Mart after being trampled in Black Friday stampede", and as the title suggested, one of the wal-mart workers got trampled to death along with "four shoppers, including a woman eight months pregnant, were injured" (above article). This year's Black Friday in Long Island Wal-mart had an "'out-of-control' mob of frenzied shoppers". There was "roughly 2,000 people gathered outside the Wal-Mart's doors in the predawn darkness" and the workers have to take "the doors off the hinges". Crazy isn't it?
This incident connects to the American way of life in a lot of ways. Generally it shows that people are selfish, ignorant (Massiel), "don't have their priorities straight" (Andy Lu), and they "rather save money" (Andy Lu). Because of this out break of people, workers have to fight and get out of the way to "live". At the end of the article, one of the employee says, "How could you take a man's life to save $20 on a TV?" This shows how we care for the "$20 on a TV" rather than the "man's life" and how we put our desires first. But thinking about it, it is also dangerous to stop yourself and save the man because you would get trample too. I don't think whoever trample over that man knew they were trampling over a man and after they know the incident, felt that it was not really their fault. When the class were having a discussion today, I strongly agree with one of the classmates who said money can be earn through time but no one can revive a person's life.
This also connects to how the when there are rush hours or just not really rush hours but alot of people, people would push and elbow others to get out of the way. That can cause injuries or verbal/physical fights between each other because a lot of people are hot-tempered about these things. It just shows how we don't care about our stuff but just need to get the obstacles away.

Thanksgiving Day...Buy Nothing Day...Black Friday...hmmm....

It seems that Thanksgiving does bring people more together and all the yummy, and warm food that the families make for the whole family gives out a nice feeling... and it kind of gives out the message of "enjoy it with your family as much as possible in one day with all the yummy foods".~~

*We have more competitive power hahaha~* Maybe because the economic is fallng quite down, people are trying to get the cheap stuff to save themselves but it also shows our greediness in things.

Constitution Assignment PART B

Article 6: What is the Supreme Law of the Land? What is the significance, in your opinion, of the “No religious test” clause?
The Supreme Law of the Land is the constitution and the laws in the United States.

Article 7: What was necessary for the ratification of the Constitution? Why “Conventions” not “State Legislatures”? Why 9? Does this seem like a fair process to you? Why or why not?
What was necessary for the ratification of the Constitution is to have nine out of the thirteen states to approve the Constitution. They chose the conventions and not the state legislatures because the “framers” had doubts for if the state legislature would approve of the new government. I think the “framers” chose only nine of thirteen states to approve the Constitution because they do not think that everybody or all the states would agree to the Constitution and how “it would be extremely difficult to win unanimous approval” (blue ink of article 7). I think this seems like a fair process to me because back then, they did not have 50 states, and they only have thirteen states, so even though it is a small number, that’s all they can do for the ratification of the Constitution. Also there is not an equal amount of states, thirteen can’t be divided by two and having nine as the approval number makes it more equal to approve the Constitution which was a big matter at that time. About not choosing the state legislature but the conventions, I do not really have an idea as to why the “framers” would have doubts but I still think the state legislatures should have a say (if they have not) because the constitution resides with everyone in the United States.

Does the 2nd Amendment seem to you to allow “well-organized militias” to have guns, or to allow all people to have guns? Make an argument.
I do not think we should carried guns and let the “well-organized militias” to carried guns and arms. Many people does not know how to use guns and arms and if by mistake, they could hurt themselves while using an arm they do not know perfectly. Since “well-organized militias” have their training and using many years of their lives to know how to use arms to protect people, they should be the one to have guns. For example, if a crazy person who is not in a militia carried guns and randomly shoot and kill people then it would cause chaos. Guns can also go off by themselves if they did not locked the gun properly so then it is dangerous for unpracticed people to use guns. I believe that carrying a gun could also affect how you would feel on the street because people would get too cautious and thinks that everyone is going to hurt them.

Do “lethal injection” and/or the “electric chair” contradicts the 8th amendment? Why/why not?
I think the “lethal injection” and/or the “electric chair” contradicts with the 8th Amendment because people should not be just punished to death (which I believe the lethal injection and the electrical chair would cause). I believe the “lethal injection” and the “electric chair” is the very extreme punishment. Since the eighth amendment is saying that the bail and punishments have to be fair, I do not think those two punishments are fair to give out. I think the this amendment is to tell the judges to not go overboard with any of the punishments but to be give out fair and reasonable charges/punishments (not like “lethal injection” or the “electric chair”). I agree that “lethal injection” or the “electrical chair” is “cruel and unusual punishments” because there are not many people who get punished with the chair or the injection. Also imagining and thinking about the “lethal injection” or the “electrical chair” gives cruel images of the tortured people. I would feel sorry for them even if they committed a crime.

Constitution Assignment PART A

The Preamble
"We the people of the United States, in order to form a more perfect union, establish justic, insure domestic transquility, provide for the common defense, promote the general welfare and secure the blessings of liberty to ourselves and our prosterity, do ordain and established this constitution for the United States of America." In the preamble, "we the people of the United States" would indicate you, me and each of the people living in the United States. Then they list all the things that would make the United Sates better and to protect the people of the United States. "We the people of the United States" is the most important phrase in the preamble, and where the government derives its power from the people to creat an "orderly, stable and just society" (taken from the textbook).

Legislative Branch - they are the closest and most directly reponsible to the people
-House of Representatives - responsible to the "will" of people. They also have to conduct a census to determine how many members they should have for each state in the congress. They also have the power to choose their own speakers and officers.
-Senate - they are less direct to the people so they are elected every 6 years but since they only have two people in each state, they are responsible to prevent larger states with bigger populations for dominanting smaller states. The senate is also like a big boss where the other officers cannot tell the senate what to do and when impeachment happens, the senate becomes a court.
Both the House of Representatives have their own rules in how they control their members and Congress cannot be arrested for what they say.
Powers of Congress: the power to borrow money and one kind of money in U.S; to creat a clear, uncomplicated system of trade; regulate the way which immigrants can become U.S. citizens; regulate international relations especially when it comes to war; provide and maintaining a navy; mail, knowledge and copyright exchange.
one of the responsibilities (or powers that Congress can't have) is that they cannot arrest citizens who did not commit a crime(which saves the people from getting told by the higher-ups of the government if they haven't done anything wrong).
(Also, the president have to obey some of the powers that the senates and house of representatives have and vice versa such as signing a bill from the president, if the president doesn't sign it, it turns into a law. Then with the president, the president needs approval for the treaties and appointments from the senates/supreme court)

Executive Branch - President and the Vice President
Electoral College: state legislatures decide how electors for that state will be chosen. Number of electoral votes = number of senators and representatives.
Responsibilities: becoming the president, the candidates have to be a natural born citizen, and 14 years resident to be eligible (and over the age of 35..that's old).
The president swears oath to the Constitution and only the constitution(not the country of USA).
- Duties of the President: give a state of Union address occasionally, adjourn Congress if 2 hourses are divide about a matter; receive ambassadors and commission officers; MAKE SURE THE LAWS OF THE U.S. ARE FAITHFULLY EXECUTED.
Power:
-The president becomes the commander in chief, for the army and the navy of the U.S.
-The president have the power to grant pardons
-The Congress cannot change the salary of the president in the middle of a term (aren't the president lucky?)
-When the president dies, the vice president takes over the president's seat

Judicial Branch
Responsibilities and powers:
The salary of the federal judges cannot be reduced (unless they do not maintain their "good behavior" and makes bad judgements).
Jurisdiction - the Supreme Court handles cases involving the Constitution, federal laws, treaties, and diplomatic officials, and international cases between the U.S.
Supreme Court - they can appeal judgements of lower courts
- first ones to hear and decide cases (foreign ambassadors and individual states)

The first task that the constitution group did was memorizing the preamble. It was quite fun memorizing the preamble, plus watching and listening others memorizing the preamble. However, when I look at the constituion it was very long, which awe me a bit. The legislation part of the constitution was long which started to bore me and there was some frustration too because its hard to understand what the constitution are saying even though there are the blue printed words explaining it.

5 insights/questions
-Is the president himself really swearing the oath to all of the people or the government in the constitution like the constitution says?
-How do the government know how their laws are proper or just? Do they know what is just? Can their laws benefit everyone or just part of the people/groups/classes of the United States?
-"We the people" do not actually refer to the people of the United States, meaning us today because it has been made a long time ago and ti was signed by the rich people. So is the preamble really directing the saying to us or some other people (in the past?)? And the list of the things/goals that the preamble said, can it be formed or is it still forming today?
-Is it possible to impeach the judges? How?
- Why does treason not apply to the congress? Is it because they are the protectors or maybe not of the United States? (Article, Section6 and Article 3, section 3)

Election Response

"OBAMA WON! OBAMA WON! OBAMA WON!" was the biggest news that came out on Tuesday night and the next and the next day and so on for lots more days, and weeks. It is very exciting to see that it is history's first African American to become president. I think it is having an impact and encouragement on the other African American because they are, especially the kids are saying, "If Obama can become president, I can too in the future." Also, a lot of people are having high expectations for Obama and I do too because of what is going on with the economy and other problems in U.S. I agree with Mr. Andy how the expectations that people have on Obama are that it is going to be hard for Obama to overcome the problems. However, many people and I included will cheer him on if by some miracle, Obama has ideas to make the economy better again.
Questions that I have are: Will Obama be able to fix the medicial issues like the healthcare? What ideas that he has that can make the economy and having the people who have lost their jobs regain their jobs or other jobs? I hope that he can surpass and solve the problems like he winning the presidental election. xD

The Dominant Framworks of American Way of Life Pt1

The Dominant Frameworks of the American Way of Life is a mix of capitalism and the government working together which networks how people live and decisions. One of the frameworks that I will be talking about is capitalism. Capitalism is an economic system that consists of private ownership of wealth, profit motive (making money), and producing products/goods and sell those goods in the free market.
In capitalism, there is also economics involve in the free markets = lots of commodities (something that can be bought and sold in the market place or perfectly substituable) and competition. The good thing about the competition is that if a lot of people are competing in one thing then prices would go down which means people can afford the price better than before. "The virtue of free enterprise capitalism is that it sets one businessman against another and it’s a most effective device for control." (Brian Doherty, "Quotations From Chairman Milton" http://www.reason.com/news/show/118175.html). Having the market to be control is a good thing using capitalism because it will keep the capitalists away from having too much power or else the smaller businesses would go down or bankrupt. This quote is agreeing how if businesses if fighting/competing agains other businesses than in the end there won't be just one business that have a lot of powers.
There is not much government interferences in capitalism which makes it a good thing since people don't like the government interfering the market or surpluses and low shortages can happened. One of the important things about the economics in capitalism is the Supply (the availability for sale of a commodity of all prices) and Demand (the amount purchase of a commodity at all price) which helps the sellers or the market to know the right prices to sell at and get good profit.
History is involved with capitalism too because around 1700, capitalism was introduce to Netherlands, Great Britain, the United States and then the rest of the world making a huge "wealth explosion" said by historian Steven Davies. It helped "secure[s] private property, the rule of law, open markets, and economic freedom generally — or what Adam Smith called “peace, easy taxes, and a tolerable administration of justice.' Capitalism has made the West rich and thus healthier and longer-lived. It could do the same for Africa, Asia, and the Arab world" (David Boaz, "Capitalism Saves", http://www.cato-at-liberty.org/2006/07/29/capitalism-saves/). The whole essay gives a positive tone about how capitalism is a good thing and even the title "Capitalism Saves" says what the whole essay is going to be about that Capitalism does save people. After capitalism was introduced, the countries who used capitalism had made themselves more richer and in a case, able to let people become more "healthier" and live longer. I agree with what David Boaz said because if we are able to do what we want in the market/capitalism way with some kind of limit because there is limit to what one can do then it makes our lives better. Well...if the person/people actually made themselves richer. I also agree that capitalism should be introduce to other parts of the world like "Africa, Asia, and the Arab world" because I think they might need more money, more capitalism to make their countries more control and stable. Since capitalism makes us live healthier and live longer, I think it is a good thing that America does uses capitalism and how the markets are going freely with the "invisible hand" makes the whole thing (I guess the country, benefits people, more profit) better.
Everybody work hard to get to where they want and capitalism is one of those ways they can do that because they are free if they are in capitalism to decide what to do. They get their own wealth and there are no limited.

how capitalism work and the good of capitalism

Capitalism is an economic system that consists of private ownership of wealth, profit motive (making money), and producing products/goods and sell those goods in the free market. Response to I, Pencil - By Leonard E. Read

In "I, Pencil", it is about the author narrating as a pencil and explains the process of the makings of the pencils. Then he goes and talks about how there is an invisible hand at work that helps the people flow through. I think the main idea is we do not notice the hard work that the workers who make the things, for example, like the pencil and take it for granted. When the author/the pencil said, "Yet, not a single person on the face of this earth knows how to make me". We all hold a pencil before (maybe 98% of the population) but we never really thought about things that made the pencil a pencil because in our eyes, we see it as a simple writing tool. However, the truth is that it takes a long time and instructions/steps to make that one pencil. The pencil says, "But, sadly, I am taken for granted by those who use me, as if I were a mere incident and without background." This bought my attention that we take things for granted and is not really grateful for what happens behind the makings of those things. We just think that the pencil looks so simple that it can be easily made when it is not. Finally, he says that "Each of these millions sees that he can thus exchange his tiny know-how for the goods and services he needs or wants. I may or may not be among these items." Everybody have goals and meets that they want and need that is highly important which makes everybody misses out the smaller things that we need that is equal important. Like the pencil, we need the pencil to write but some people does not think that. I think our minds think that pencil is not of great importance when it is because we use it often like everyday and we do not notice that. "No individual possesses enough know-how to perform a nation's mail delivery any more than any individual possesses enough know-how to make a pencil." It seems like we know the basics of what happen with many things but we actually dont know the depth of everything that is made or created. We are all kind of "blind" on how we see everything because we mostly see the stuff that is simple-looking, simple, and not care much about it and use it.
I think that the story tells how some people or everbody have the knowledge or some knowledge for specific things, like the workers who know how to make the pencil and some people just not notice anything. In a way, we use each other to gain the knowledge to make stuff and those knowledge came from the resouces that we have. Like the workers have to use the tree, coals, rubber, and etc to make the pencils and the workers are being used by the people who paid them. Then we buy the products/goods or the pencils from the company and they make the money. (It is like the Circular Flow Model) Also I feel that behind the scene, when the pencil was talking about the "master mind" that it is the "invisible hand" that it is talking about. We are following that invisible hand that creates the market and capitalism (maybe) because we all have the desires to get "rich", profit motive, and that we use others as a "stepping stone" to do that. What I am trying to say is that we are all in the same circle but we worked in different levels and since some people know how to do something, other people would use them for their advantageous/to make money or they make it with other people to get the profit they want. It is like there is something that is making everything "flow" in a way to make "society to act in harmony" (sometimes if there is a huge uproar).

Other people's views on the American Way of Life Part 2

A lot of people have different aspects of what the American Way of Life is.
So noticing about the age difference, the “success” of the American Way of Life for the children and non working teens are different than the “success” of the American Way of Life for the adults.
One general observation that I noticed after interviewing a number of people is that they do not really define what is the American Way of Life but rather describing what America is but not the Way of Life. Also not every body lives in an American Way of Life because like one of them says, we "live how we want".

Other people's views on the American Way of Life

Assignment #3:

A lot of people have different aspects of what the American Way of Life is. By saying that the American Way of Life has a lot of “freedom” (said by others) shows how we have more opportunities than other countries.
MY WAY of LiFE iN MY ViEW

DESCRIPTION:

1. What have you included in this video?
I have include a lot of anime pictures or animes that I like. I took pictures of a bunch of manga books that have different titles together, and a drawing that I did on the manga and anime "Vampire Knight." Also the first picture that was shown on the slideshow is my three stuff toys, Tohru, Naruto, and Ichigo. The song in the background is titled the "Musician".

2. Explain how different parts of the video relate to your way of life.
This video is showing how I view as my way of life is so I am not in there. One of the aspects of my life, is ANIME and MANGA. Mostly everyday at home, I either watch anime or read manga or do both. The pictures that has a a lot of mangas taken together shows how I cherish and love my mangas. I get to learn a lot of things from different sort of genres of anime or manga and actually seeing the actions or drawings of what the mangaka/artists are trying to show. xD
Besides doing those two, I would chat and hang out with my friends either through internet, or games or just face to face. Friends are what I cherish alot besides anime and manga. In the slideshow, I used some of the anime pictures to represent my friends, for example, the pictures with 5 little kids in there (anime: Detective Conan). Additionally, I put “Ore wa ore de iyou” which is in Japanese (its in the “he” form, not “she” but I am using it to represent me) in the slideshow, which sort of means, “being me is fine”. I like how I am now and how people should be their own self rather than having to be a replica of someone else.

3. What's seems good about your way of life? What's bad? What's neutral?
The things that seem good about my way of life are that my life now is quite relaxed, I mean more relax than the other people who are really busy and have no time to do anything they like. However, I am able to reserve time to do what I like, basically anime, manga, playing games, and chatting with friends. I also have friends that support me. Almost towards the end of the slideshow, a picture shows a hand with an "x" on it, representing no matter what happens; my friends and I will still be friends.
What seems bad about my life are how when I found an anime or manga that I liked, within the period of time, some kind of anime company would come and license it. Therefore, the fansub groups can not be allowed to sub the anime causing me to stop the anime half way, which is bad for me. Other than that, there are a lot of things and adventures I wish to do, however I am not able to grant it because 1) not enough money, 2) mostly every parents wish their kids to have their education at top and my parents are one of them and 3) finding a job has a low percentage for me. So there are a lot of unfair things in my life as a teenagers right now.
The neutral part of my life is okay. I like the apartment I live in, and going to school is okay too. I do not have much complaint generally in how I am living now but I just think that maybe New York should add more nature and "green" around the City.

4. What would you have liked to have included, that is important to your way of life, but weren't able to?
I would have put my friends pictures on the slideshow but weren't able to because either my friends do not like taking pictures or they are shy. However I think it is okay since it is best not to push people to something they do not want to do. =]

Anime & Manga...Jia Min's Way of LiFE ~~<3 from Jia Min on Vimeo.

5. What's going on with your way of life? What seems to be the general pattern or direction or point or situation?
What's going on with my way of life and the general pattern of my life are going to school, learning what the teachers are teaching, on Tuesday going to comic class. Then I go home after school ends. I would spend most of my time on the computer watching anime or reading manga online and chatting with my friends or playing games.

6. How do the good, bad, and neutral in your way of life fit together?
Having all the good such as anime and manga =] plus my friends and other things I think about in the day and night happening in my life with the bad things such as having to stress over things like homework, and life xD with neutral parts all fits in to my life. If not, I think it is a boring life and having all those good, bad, and neutral parts give me experiences and how can I fix it in the future if it happens again. In my life, good and bad things always happen everyday in some kind of order. Sometimes it drives me crazy but I would wonder why are these bad things happening to me?

7. Does your way of life seem like a "typical American Way of Life"? Why or why not?
My way of life seems like a typical American way of life because I go online and do media such as watching videos, chatting with friends online and playing games. Also going to school by subway, going to movies, and hanging out with friends.
My way of life also does not seem like a typical American way of life because my interests are mostly in anime and manga, which not most of the typical Americans do. It is like everybody has their own world in their mind of things they do that they do themselves. I am like that too. Sometimes I rather be in my own little world thinking about a lot of topics where I do not like to get distracted. One of those topics are anime and manga. When I try to focus on the videos or the book, and somebody comes in to my world and started bothering or talking to me, it would start getting annoying.

8. What aspects of your way of life seem really interesting to you – you’d like to think about them more deeply, figure out how this sort of thing developed historically, what’s going to happen to this aspect of your way of life within your lifetime? What questions do you have about these really interesting aspects of your way of life?
Why are there a lot of things that we cannot control? Why can people not accept how other people are and have to go say something? Is it because in their heart the feelings that they have towards those people are bad or something else? Why do people have to blame it on others rather than asking first about the situation they were in? Why are the children are the ones that suffers when the grown-ups can't do anything? Why are there no air conditioner in the subway stations?!
Anime and Manga: Why can't the anime be continue when the people who are going to license it is going to release that anime in a year or so? Can't we still watch it without buying it? Why are anime and manga store so far away in New York City?
